You are the Manager: Logistics and Transportation of Minura Mining, a company that owns
a Uranium Mine in the coastal area of Namibia. It is your responsibility, amongst others, to
manage all transportation matters within the company, including ensuring that vehicles are
safe and meet legal requirements, and making sure that drivers are aware oftheir duties.
Answer the following questions:

2.2 A "competent authority" is charged with the enforcement ofthe regulations
governing the transportation of dangerous goods. Who is the "competent authority"
in Namibia?

neighbouring country. The consignments will be transported by road. Because of the
nature of the consignment, you wish to avoid the publicity that accompanies
transporting dangerous goods by road. How can you avoid this and what is the
procedure to be followed?

age that these drivers should be?

You have to organise the transportation of mining equipment from Walvis Bay to the
mine. The consignment consists of six disassembled dump trucks that are 5 metres
wide and weigh approximately 30 tonnes each. Will this be regarded as an abnormal
load? Motivate your answer.

Read the following case study and indicate which human rights have been infringed. Refer
to the exact articles.
On 13 November 2025 Mr Thomas, an elderly man from Angola who cannot speak English,
is stopped at a road block outside Windhoek. The English-speaking traffic officer demands to
see his passport. Mr Thomas does not understand the traffic officer and does not have his
passport with him. He is summarily arrested on suspicion of being an illegal immigrant and
thrown into the back of a Police vehicle. He is kept in isolation in the Police cells at Hosea
Kutako airport prison and not permitted to speak to anybody from outside. He is also
beaten up by the Police and given rotten food to eat. His trial takes place on 20 November
2025. He is not given a chance to state his case, but is immediately found guilty by the
Magistrate, who said: "you Angolans always think you can just come into Namibia and do
what you want"

5.1 During an inspection of a motor vehicle, you find that the engine number of the
vehicle is different from the one that is specified on the registration document. In
terms of your functions as traffic officer, how do you handle this matter?

5.2 Jona has just bought himself a brand new Amarok and wants to apply for a
Personalised Licence Number (PLN). After some thought he decides on IAMTHEBEST
NA. He further decides to include the Angolan flag, because his family is originally
from Luanda and he still longs for that country. Will this be allowed? Motivate your
answer.

5.3 Meme Tina sells fresh fruit just outside Windhoek, along the Al highway between
Windhoek and Okahandja. She regularly waves her produce at passing motorists to
attract their attention. Her neighbour Meme Julia, who has a son studying Traffic
and Transportation Law at NUST, has told her that she may not do this, because it is
forbidden by the Advertising on Roads and Ribbon Development Ordinance 30 of
1960. Is Meme Julia correct?

5.4 Mr Rich owns a number of taxis. He employs various taxi-drivers. On 3 May 2018
Mathew, one of his drivers, is apprehended at a road block by Inspector Chicken,
because the vehicle he was driving was not road-worthy. Who can be held liable in
this instance? Motivate your answer.

5.5 Mr.Xis caught by a Traffic Officer driving without a licence. The Traffic Officer fines
Mr. X N$ 2000 for driving on a public road without a valid driver's licence. Mr. X was
driving on a public road from one part of his farm to another part, which is less than
one kilometre away. Must Mr. X pay the fine? Motivate your answer.

5.6 One morning Innocent wakes up to discover that her brand-new motor vehicle has
disappeared. She reports the matter to the Police. Three days later the Police, acting
on a tip-off, go to arrest Veri Scaly at his house. They discover that his garage is
crammed with motor vehicle parts that are identified to belong to various motor
vehicles that were reported stolen during the past six months. Name the legislation
that the Police can use to secure a conviction in this regard.

5.7 On 15 February 2024 the Namibian parliament, in an attempt to combat gender-
based violence, passes a law stating that the death penalty can be imposed in
instances where an accused is convicted of rape. In March 2024 Tsotsiman is
arrested and subsequently found guilty of rape. Can he be sentenced to death?
